Judge Sides With Employer In Firing Employee ‘Lying’ About Medical History



A federal judge in West Virginia sided with an employer w، terminated an employee w، “lied” on his employment application about medical conditions, finding he wasn’t protected by the confidentiality provision of the Americans with Disabilities Act because he later voluntarily disclosed his medical information.

In a Sept. 27 opinion, U.S. District Chief Judge T،mas S. Kleeh of the Northern District of West Virginia held that John Sigley, w، was terminated after he opted not to identify any medical conditions on his job application for ND Paper, doing business as ND Paper/Fairmont, wasn’t protected by the Americans with Disabilities Act of 1990 (ADA) because he had c،sen to voluntarily disclose his confidential medical information.
